{"id":5535,"date":"2025-04-10T08:30:16","date_gmt":"2025-04-10T08:30:16","guid":{"rendered":"https:\/\/uni.hi.is\/helmut\/?p=5535"},"modified":"2025-04-25T10:02:12","modified_gmt":"2025-04-25T10:02:12","slug":"it-security-needs-legal-certainty","status":"publish","type":"post","link":"https:\/\/uni.hi.is\/helmut\/2025\/04\/10\/it-security-needs-legal-certainty\/","title":{"rendered":"Coalition agreement in Germany: more digital surveillance, but at least  IT security gets legal certainty"},"content":{"rendered":"<p>The <a href=\"https:\/\/www.cdu.de\/app\/uploads\/2025\/04\/Koalitionsvertrag-2025.pdf\">coalition agreement<\/a> of the new Government that is forming aims at more digital surveillance (e.g. data retention in telecommunication, face and number plate recognition). While this is not good for privacy, at least IT security gets legal certainty:<\/p>\n<p>In the Germany, there is the problem that IT security researchers who report vulnerabilities to companies (<em>Responsible Disclosure<\/em>) are sometimes sued by these companies based on a German legislation that was supposed to make breaking into IT systems a crime. I signed a <a href=\"https:\/\/cysec-reform.jetzt\/#fn5\">petition of IT security researchers to change that legislation in order to prevent that Responsible Disclosure can be made a crime<\/a>. The hope was that the currently forming government will change legislation and indeed: <\/p>\n<p>The new <a href=\"https:\/\/www.cdu.de\/app\/uploads\/2025\/04\/Koalitionsvertrag-2025.pdf\">coalition agreement<\/a> covers cybersecurity at some places in an abstract manner and also includes the above legislative change:<\/p>\n<blockquote><p>\n<strong>Cyberstrafrecht, Deepfakes, Strafbarkeit Plattformbetreiber und Hackerparagraph<\/strong><br \/>\nWir reformieren das Cyberstrafrecht und schlie\u00dfen Strafbarkeitsl\u00fccken, zum Beispiel bei bildbasierter sexualisierter Gewalt. Dabei erfassen wir auch Deep Fakes und schlie\u00dfen L\u00fccken bei deren Zug\u00e4nglichmachung gegen\u00fcber Dritten. Wir versch\u00e4rfen die Sanktionsm\u00f6glichkeiten gegen\u00fcber Plattformen, insbesondere bei systemischen M\u00e4ngeln bei der Entfernung strafbarer Inhalte. <em>Wir werden im Computerstrafrecht Rechtssicherheit f\u00fcr IT-Sicherheitsforschung schaffen, wobei wir Missbrauchsm\u00f6glichkeiten verhindern.<\/em>\n<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>The coalition agreement of the new Government that is forming aims at more digital surveillance (e.g. data retention in telecommunication, face and number plate recognition).
